Terms and Withdrawal
These terms apply to the sale of fine art prints and the zine via one-more-light.com to consumers and businesses. The German version at AGB und Widerruf is authoritative for consumers resident in Austria.
1. Seller
Seller is Lukas Mari, Etrichstraße 17/21, 1110 Vienna, Austria, +43 650 2338611, photo@one-more-light.com (small business under § 6 para. 1 item 27 Austrian VAT Act, no VAT charged). Further details in the imprint.
2. Conclusion of contract
The presentation of products on this website is not a binding offer but an invitation to order. Orders are placed by email to photo@one-more-light.com. The contract is concluded with the order confirmation sent by email. The contract text is not stored separately; the order and confirmation emails remain available to both sides. The contract language is German or English.
3. Prices and payment
The prices stated in euros at the time of ordering apply. As a small business, no VAT is shown. After the contract is concluded, an invoice follows by email; payment is made by bank transfer to the account stated therein.
4. Delivery and shipping costs
Delivery follows receipt of payment. Any shipping costs and the expected delivery time are stated before the contract is concluded, in the order confirmation. For consumers, the risk of loss or damage passes only on handover to the consumer.
5. Consumers' right of withdrawal
Consumers have a 14-day right of withdrawal (see the withdrawal instructions below). There is no right of withdrawal for goods made to the customer's specifications or clearly tailored to personal needs (§ 18 para. 1 item 3 FAGG), for example prints produced individually in a special format.
6. Warranty
The statutory warranty provisions of Austrian law apply.
7. Rights of use
Purchasing a print or zine transfers ownership of the physical copy. Copyright and rights of use in the photographs remain with Lukas Mari. Any commercial reuse, reproduction or publication of the images requires prior written consent.
8. Applicable law and dispute resolution
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory protective provisions of their country of habitual residence remain unaffected. There is no obligation and no willingness to participate in dispute resolution proceedings before a consumer arbitration body.
Right of withdrawal
Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods.
To exercise your right of withdrawal, you must inform me (Lukas Mari, Etrichstraße 17/21, 1110 Vienna, photo@one-more-light.com) by means of a clear statement (for example a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form below, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal. If you withdraw from this contract, I will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by me), without undue delay and no later than fourteen days from the day on which I am informed of your decision to withdraw. I will use the same means of payment as you used for the initial transaction, unless expressly agreed otherwise; in no case will you incur any fees as a result of this reimbursement. I may withhold reimbursement until I have received the goods back, or until you have supplied evidence of having sent the goods back, whichever is the earliest.
You must send back or hand over the goods to me without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
